1. ACCEPTANCE OF TERMS
By using this site, you signify your assent to these Terms and Conditions of Use (“Terms and Conditions” or “Terms of Use”). If you do not agree to all of these Terms and Conditions of use, do not use this site ! The webpages available at www.rhin.com and certain linked pages ("Site"), are owned and operated by Rehabilitation Hospital of Indiana (“RHI”), an Indiana corporation, and is accessed by you under the Terms of Use described below. The Site includes the RHI Community or Network hosted by Ning.com, and by accessing the RHI Community, you agree to abide by and you assent to the Ning Privacy Policy and the Ning Terms of Service as well as these Terms and Conditions. Similarly, you agree to abide by and you assent to the terms and conditions pertaining to our Facebook and Myspace sites.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING THIS SITE OR USING ANY PART OF THE SITE OR ANY CONTENT OR SERVICES (AS EACH IS DEFINED BELOW) ON THE SITE, YOU AGREE TO BECOME BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS, THEN YOU MAY NOT ACCESS THE SITE OR USE THE CONTENT OR ANY SERVICES IN THE SITE. RHI’S ACCEPTANCE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL OF THESE TERMS AND CONDITIONS, TO THE EXCLUSION OF ALL OTHER TERMS; IF THESE TERMS AND CONDITIONS ARE CONSIDERED AN OFFER BY RHI, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS.

2. MODIFICATION OF TERMS OF USE
RHI reserves the right, at its sole discretion, to modify, replace, revise and update these Terms and Conditions at any time and without notice. Your continued usage of the RHI website ("RHI Site," or the "Site,") will mean you accept those changes.

3. DESCRIPTION OF SERVICE
Subject to full compliance with the Terms of Use, RHI may offer to provide certain services and content, as described more fully on the Site, ("Services"). Services shall include, but not be limited to, any service and content RHI performs for you, as well as the offering of any materials displayed, transmitted or performed on the Site or through the Services (including, but not limited to text, user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, graphics, software, audio clips and video clips, also known as the "Content"). RHI may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. RHI may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

4. YOUR REGISTRATION OBLIGATIONS
As a condition to using Services, specifically the RHI Community Site site, you are required to register and select a password and screen name ("RHI Community User ID"). You shall provide RHI with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your RHI Community account. You may not (i) select or use as a RHI Community User ID a name of another person with the intent to impersonate that person; (ii) use as a RHI Community User ID a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a RHI Community User ID a name that is otherwise offensive, vulgar or obscene. RHI reserves the right to refuse registration of, or cancel a RHI Community User ID in its discretion. You shall be responsible for maintaining the confidentiality of your RHI Community password.

RHI has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your RHI Community passwords or accounts. It is your sole responsibility to (1) control the dissemination and use of activation codes and passwords; (2) authorize, monitor, and control access to and use of your RHI Community account and password; (3) promptly inform RHI of any need to deactivate a password. You grant RHI and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. RHI cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using RHI tools and services.

Services are available only to individuals who are at least 13 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you do not so qualify, do not attempt to register for or use the Services.

5. THIS SITE DOES NOT PROVIDE MEDICAL ADVICE
The Contents of the RHI Community Site, including without limitaiton any information obtained from RHI's licensors, are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the RHI Site!

If you think you may have a medical emergency, call your doctor or 911 immediately. RHI does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by RHI, RHI employees, others appearing on the Site at the invitation of RHI, or other visitors to the Site is solely at your own risk.

The Site may contain health- or medical-related materials that are sexually explicit. If you find these materials offensive, you may not want to use our Site.

6. USE OF CONTENT
RHI authorizes you to view or download a single copy of the material on the RHI Site solely for your personal, noncommercial use if you include the following copyright notice: "Copyright © 2004-2008, Rehabilitation Hospital of Indiana. All rights reserved" and other copyright and proprietary rights notices that are contained in the Content. Any special rules for the use of certain software and other items accessible on the RHI Site may be included elsewhere within the Site and are incorporated into these Terms and Conditions by reference.

The Content is protected by copyright under both United States and foreign laws. Title to the Content remains with RHI or its licensors. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of RHI. All rights not expressly granted herein are reserved to RHI and its licensors.

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

7. CONTENT SUBMITTED OR MADE AVAILABLE BY YOU FOR INCLUSION ON THE SERVICE
By uploading, submitting or otherwise disclosing or distributing Content for display or inclusion on the RHI Community Site, you represent and warrant that you own all rights in the Content and you agree that the Content will be dedicated to the public domain under the Creative Commons Public Domain Dedication, available at http://creativecommons.org/licenses/publicdomain/. For clarity, the foregoing does not apply to the Content on any external sites to which the Services link; rather, the terms and conditions and privacy policies of those sites will control.

The personal information you submit to RHI is governed by the RHI Privacy Policy. To the extent there is an inconsistency between this Agreement and the RHI Privacy Policy, this Agreement shall govern.

You agree that you will not upload or transmit any communications or content of any type to the Public Areas (including blogs, message boards, Ask Our Expert postings, etc.) that infringe or violate any rights of any party. By submitting communications or content to the Public Areas, you agree that such submission is non-confidential for all purposes.

If you make any such submission You agree that you will not send or transmit to RHI by email, (including through the email addresses listed on the "Contact Us" link) any communication or content that infringes or violates any rights of any party. If you submit any business information, idea, concept or invention to RHI by email, you agree such submission is non-confidential for all purposes.

If you make any submission to a Public Area or if you submit any business information, idea, concept or invention to RHI by email, you automatically grant-or warrant that the owner of such content or intellectual property has expressly granted to RHI a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed. RHI may sublicense its rights through multiple tiers of sublicenses. If you wish to keep any business information, ideas, concepts or inventions private or proprietary, do not submit them to the Public Areas or to RHI by email.

8. USER SUBMISSION—IMAGE, VIDEO, AUDIO FILES
You agree to only post or upload Media (like photos, videos or audio) that you have taken yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy, right of publicity or any other rights of any other person. Photos or videos of celebrities and cartoon or comic images are usually copyrighted by the owner. To protect your privacy, you agree that you will not submit any media that contains Personally Identifiable Information (like name, phone number, email address or web site URL) of you or of anyone else. Uploading media like images or video of other people without their permission is strictly prohibited.

By uploading any media on the RHI Community site, you warrant that you have permission from all persons appearing in your media for you to make this contribution and grant rights described herin. Never post a picture or video of or with someone else unless you have their explicit permission.

It is strictly prohibited to upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions, the RHI Advertising Policy and the RHI Privacy Policy.

You agree that you will not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, limit the functionality of or otherwise cause harm to any computer software or this Web Site.

By uploading any media like a photo or video: (a) you grant to RHI a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; and (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes RHI to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) you agree to indemnify RHI and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from the media and/or your failure to comply with these the terms described in this document.

RHI reserves the right to review all media prior to submission to the site and to remove any media for any reason, at any time, without prior notice, at our sole discretion.

9. COPYRIGHT COMPLAINTS, NOTICE AND TAKEDOWN PROCEDURES, AND COPYRIGHT AGENT
RHI respects the intellectual property of others. It is RHI's policy to respond expeditiously to claims of copyright and other intellectual property infringement. RHI will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, RHI may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. RHI will terminate access for subscribers and account holders who are repeat infringers.

Notifying RHI of Copyright Infringement: If you believe any materials accessible on or from the Site infringe your copyright, you may request removal of those materials (or access thereto) from this web site by contacting RHI's copyright agent (identified below) and providing the following information:

Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.

Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.

RHI, and other RHI graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of RHI in the U.S. and/or other countries. RHI's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion. The images and icons available in the RHI icon pack may used by partner and third party sites in connection with providing appropriate "RHI This" and "Submit to RHI" links to the RHI site.

11. PRIVACY POLICY
RHI's complete privacy policy is available at http://www.rhin.com/page/privacy (the "Privacy Policy"), which is incorporated by this reference.

12. CHILDREN’S PRIVACY
We are committed to protecting the privacy of children. You should be aware that this Site is not intended or designed to attract children under the age of 13. We do not specifically collect personally identifiable information from any person we actually know is a child under the age of 13. If we learn that RHI has collected information from a child under the age of 13, we will delete that information as quickly as possible. We recommend that minors between the ages of 13 and 18 ask and receive their parents’ permission before using the RHI Site or sending information about themselves or anyone else over the Internet.

13. SUBSCRIPTION SERVICES
If you choose to subscribe to one of RHI's subscription services, like the RHI eNewsletter, the following additional terms and conditions will apply depending on which service you choose. You should be aware that the RHI Subscription Services are not intended or designed to attract children under the age of 18. These services do not collect any Personally Identifiable Information from any person we know to be a child under the age of 18.

INFORMATION YOU SUBMIT: You are using the Subscription Services at your own risk and you, along with your healthcare provider, are personally responsible for verifying its suitability for your needs.

CHARGES AND BILLING: You are responsible for providing a valid credit card number at the time you register for a Subscription Service. You represent and warrant that you are an authorized user of such credit card, and you agree to pay all charges resulting from your Subscription Service account at the prices then in effect, including any unauthorized charges incurred prior to your notifying RHI of such charges. You agree that RHI may pass your credit card information and related personally identifiable information to its designated service provider(s) for their use in charging you for appropriate services utilized through your Subscription Service. All Subscription Service charges are exclusive of sales or other taxes and you are responsible for payment of any applicable state, local and city taxes. RHI reserves the right to modify or terminate membership plans, change prices, or institute new charges for any Subscription Service at any time with at least thirty (30) days' notice.

14. LIVE AND MEMBER-TO-MEMBER AREAS (PUBLIC AREAS)
If you use a Public Area, such as a chat room, message boards, blogs, community or Network such as www.rhicommunity.com, you are solely responsible for your own communications, the consequences of posting those communications (pursuant to these Terms of Use and those on any Network or community such as Ning, Facebook, or Myspace), and your reliance on any communications found in the Public Areas. RHI and its licensors are not responsible for the consequences of any communications in the Public Areas. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, call your doctor or 911 immediately.

In consideration of being allowed to use the Public Areas, and as a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or for any other purpose not reasonably intended by RHI. By way of example, and not as the complete universe of prohibited conduct you agree that the following actions shall constitute a material breach of these Terms and Conditions and that you will not use the Services:

for any purpose in violation of local, state, national, or international laws or for any unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable Content;

for violating any laws in your jurisdiction (including but not limited to copyright laws);

for transmitting, posting or causing to be transmitted or posted any Content or material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others or that is libelous, defamatory, slanderous, hateful, embarassing, threatening, harassing, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party as determined by RHI in ist sole discretion;

for transmitting, posting or causing to be transmitted or posted any communication or solicitation designed or intended to harvest or obtain password, account, or other private information from, for, or about any RHI user without their informed consent;

for posting advertisements or solicitations of business;

for continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form) after receiving a warning;

for posting chain letters or pyramid schemes;

for impersonating another person;

for distributing viruses or other harmful computer code;

for allowing any other person or entity to use your identification for posting or viewing comments;

for posting the same note more than once or for creating or submitting unwanted e-mail or other “Span” or "spamming" activity;

for submitting stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;

for using any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission, with the exception of accessing RSS feeds. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in RHI’s sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;

with the intention of artificially inflating or altering the 'RHI count', blog count, comments, or any other RHI service, including by way of creating separate user accounts for the purpose of artificially altering RHI's services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of RHI's services;

for advertising to, or soliciting, any user to buy or sell any products or services. It is also a violation of these rules to use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;

for impersonating or attempting to impersonate another user or person;

o sell or otherwise transfer your profile;

or for engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of RHI, exposes RHI or any of its customers or suppliers to any liability or detriment of any type.

RHI reserves the right (but is not obligated) to do any or all of the following:

Record the dialogue in public chat rooms.

Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).

Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.

Terminate a user's access to any or all Public Areas and/or the RHI Site upon any breach of these Terms and Conditions.

Monitor, edit, or disclose any communication in the Public Areas.

Edit or delete any communication(s) posted on the RHI Site, regardless of whether such communication(s) violate these standards.

RHI may remove any Content and RHI accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. To report Terms of Use abuse, please email: abuse@rhin.com

You are solely responsible for your interactions with other users of the Site. RHI reserves the right, but has no obligation, to monitor disputes between you and other users.

RHI or its licensors have no liability or responsibility to users of the RHI Site or any other person or entity for performance or nonperformance of the aforementioned activities.

14. ADVERTISEMENTS, SEARCHES AND LINKS TO OTHER SITES
The Services and/or third parties may provide links to third-party web sites or resources. RHI also may select certain sites as priority responses to search terms you enter and RHI may agree to allow advertisers to respond to certain search terms with advertisements or sponsored content. RHI does not control, does not recommend, and does not endorse the content on any third-party websites. You acknowledge and agree that RHI is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources incluidng without limitaton any sites framed within the RHI Site, any third-party sites provided as search results, or any third-party advertisements, and RHI does not make any representations regarding their content, accuracy or availability. You further acknowledge and agree that RHI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. RHI does not endorse any product, service, or treatment advertised on the RHI Site.

15. LIABILITY OF RHI AND ITS LICENSORS
The use of the RHI Site and the Content is at your sole responsibility and risk.

When using the RHI Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of RHI and its suppliers. Accordingly, RHI assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the RHI Site.

THE RHI SITE, SERVICES, AND THE CODE AND CONTENT ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS. RHI, ITS LICENSORS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, RHI, its licensors, and its suppliers make no representations or warranties about the following:

The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the RHI Site or RHI.

The satisfaction of any government regulations requiring disclosure of information on prescription drug products or the approval or compliance of any software tools with regard to the Content contained on the RHI Site.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. RHI, its licensors, its suppliers, or any third parties mentioned on the RHI Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or Public Areas (as defined below). Any claims arising in connection with your use of the Site, any Content, or the Public Areas must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

16. INDEMNITY
You agree to defend, indemnify and hold RHI, its parents, subsidiaries, affiliates, customers, suppliers, and vendors, and the officers, directors, employees, agents, licensors of same harmless from and against any liability, damage, settlement, or cost (including without limitation reasonable legal and accounting fees and cost) from any claim, action or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account or RHI User ID, of any intellectual property or other right of any person or entity.

18. TERMINATION
RHI may terminate or suspend any and all Services and your RHI account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your RHI account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

19. GENERAL
RHI is based in Indianapolis, Indiana, in the United States of America. RHI makes no claims that RHI or any Site within the RHI Network and the Content are appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the RHI Network from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. This Agreement will be interpretted using the English language. At a minimum, the following provisions, and all provisions that by their nature are meant to survice, will survive the expiration or termination of this Agreement for any reason whatsoever: Liability, User Submissions, User Submissions – image, video, audio files, Indemnity, Jurisdiction, and Complete Agreement.
